Terms and conditions
The terms that apply to RJL quotes, supply, installation, maintenance and call-outs, and the disclaimer for this website and our brochures. Last updated 24 October 2026.
Part A — Terms and Conditions of Quotation, Supply, Installation and Service
RJL Commercial Fencing and Gates (VIC) Pty Ltd, ABN 37 652 237 431, trading as RJL Commercial Group ("RJL", "we", "us"). "Client" or "you" means the person or entity that requests a quote or accepts it.
1. Application
1.1 These terms apply to every quote, order, supply, installation, repair, maintenance plan and call-out by RJL, unless RJL agrees otherwise in writing.
1.2 If a written quote and these terms conflict, the written quote prevails.
1.3 You accept these terms when you accept a quote in writing, pay a deposit, issue a purchase order or allow work to start. Terms printed on your purchase order do not apply unless RJL agrees to them in writing.
2. Quotes and advertised prices
2.1 Quotes are valid for 30 days unless stated otherwise.
2.2 Prices shown as "from" in brochures, on this website or in advertising are indicative only. They are not an offer and are based on the assumptions stated with them. The price for your job is the price in RJL's written quote.
2.3 All prices are in Australian dollars and include GST unless stated otherwise.
2.4 Quotes are based on the information you gave us and on what was visible at the site. If a supplier increases a price before materials are ordered, RJL may adjust the quote by the amount of that increase after telling you in writing. You may then cancel without penalty before materials are ordered.
3. What is not included unless the quote says so
Unless listed as included in the written quote, the following are extra and will be quoted or charged as a variation:
- (a) electrical work by a licensed electrician, including new circuits, switchboard work and cable runs;
- (b) plumbing and stormwater drainage, including a drain to stormwater where the ground fails a soak test or the manufacturer specifies one, sump pits and pumps;
- (c) vacuum (non-destructive) excavation, service locating and potholing;
- (d) excavation in rock, hard or unstable ground, fill, or ground containing tree roots, rubble or obstructions;
- (e) concrete or asphalt cutting, core drilling, scanning of slabs, and reinstatement or matching of surface finishes;
- (f) work in suspended or post-tensioned slabs, which needs an engineer's approval;
- (g) removal and disposal of contaminated soil, asbestos or hazardous material, and spoil removal beyond what the quote states;
- (h) traffic management, road or footpath permits, council or authority approvals and their fees;
- (i) engineering design, certification, structural assessment and soil testing;
- (j) vehicle safety detection (loops, photocells, safety edges) and signals, which are required on every powered system;
- (k) network, IT, intercom and third-party system integration;
- (l) work outside normal hours (Monday to Friday, 7 am to 4 pm, excluding public holidays) at the client's request;
- (m) hire of access, lifting or excavation equipment beyond what the quote states;
- (n) removal or making good of existing gates, fences, bollards or equipment.
4. Site conditions and underground services
4.1 You must tell RJL in writing before work starts about any underground or hidden services, structures, contamination or hazards you know of, and give us any plans you hold.
4.2 RJL will lodge a Before You Dig Australia enquiry where required. Those plans can be incomplete or inaccurate. Where services may be near the dig, RJL may require vacuum excavation before digging, at your cost.
4.3 RJL is not liable for damage to services that were not shown on available plans, not disclosed by you, or not reasonably detectable, except to the extent RJL was negligent.
4.4 Conditions that could not reasonably have been foreseen at quote time (for example rock, water, contamination, hidden services or obstructions) are "latent conditions". Extra work caused by them is a variation under clause 7.
5. Your responsibilities
You must:
- (a) give RJL safe and clear access to the site during agreed hours;
- (b) confirm you own the site or have the owner's written authority for the work;
- (c) obtain any approvals that are your responsibility (for example landlord, owners corporation or council consent) unless the quote includes them;
- (d) confirm boundaries and set-out where the work is near a boundary;
- (e) provide power and water on site where reasonably required;
- (f) keep people and vehicles clear of the work area while work is in progress.
6. Payment
6.1 Unless the quote states otherwise: a deposit of 50% is payable on acceptance; progress claims may be issued for materials delivered and work completed; the balance is due on completion.
6.2 Invoices are payable within 7 days of the invoice date.
6.3 On overdue amounts RJL may charge interest at the rate fixed under the Penalty Interest Rates Act 1983 (Vic) and recover reasonable costs of collection, including legal and agency fees.
6.4 If payment is overdue, RJL may suspend work after giving 5 business days' written notice. Delay caused by a suspension is not RJL's responsibility.
6.5 Equipment may be commissioned in a locked or restricted mode until payment in full. RJL will never leave equipment in an unsafe state.
7. Variations
7.1 Any change to the scope, including extra work under clauses 3 and 4, is a variation.
7.2 RJL will tell you the cost and time effect of a variation before doing it, except where urgent work is needed for safety. Variations are confirmed in writing (email is enough).
8. Ownership of goods and security interest
8.1 Goods remain RJL's property until paid for in full.
8.2 Until then you hold the goods for RJL, and RJL may enter the site on reasonable notice to recover unpaid goods, provided removal can be done safely.
8.3 These terms create a security interest in the goods for the purposes of the Personal Property Securities Act 2009 (Cth). You agree to sign any document RJL reasonably needs to register it.
9. Timeframes and delays
9.1 Start and completion dates are estimates. RJL is not liable for delays caused by events beyond its reasonable control, including weather, supplier or freight delays, authority approvals, site access, latent conditions, or delay by you or your other contractors.
9.2 RJL will tell you promptly about any delay and the expected new date.
10. Cancellation
10.1 If you cancel after acceptance, you must pay for work done and for costs RJL has incurred or committed to, including goods ordered that cannot be returned and any supplier restocking fees. Any balance of the deposit is refunded.
10.2 Custom-made or specially ordered goods cannot be cancelled once ordered.
11. Warranty
11.1 Unless the quote states otherwise, RJL warrants its installation workmanship and new automation equipment (including gates, barriers and bollards) for 3 years, and accessories for 2 years, from the date of completion. Longer coverage for eligible custom structural steelwork and powder-coated finishes is set out in the written project warranty (see /resources/warranty-maintenance).
11.2 Any extended warranty stated in a quote applies only while an RJL preventative maintenance plan is in place and serviced as scheduled.
11.3 This warranty does not cover failure or damage caused by: vehicle impact; misuse or abuse; vandalism; lightning, power surges or electrical faults outside the equipment; flooding or water entry from blocked or unmaintained drainage; insect, vermin or rodent damage; fire; lack of maintenance or servicing; repair, alteration or tampering by anyone other than RJL, including where an RJL tamper seal has been broken; or normal wear of consumable parts such as seals, batteries, remote controls and lamps.
11.4 Manufacturer warranties are passed on to you as issued by the manufacturer.
11.5 To claim, contact RJL on 0400 101 132 or info@rjlcommercialgroup.com, or at Unit 1 / 12 Merchant Avenue, Thomastown VIC 3074, describing the problem and the installation date. RJL will inspect and repair or replace at its option. You bear your own costs of making a claim. Call-out fees apply where the fault is not covered.
11.6 Australian Consumer Law. Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled: to cancel your service contract with us; and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
11.7 The benefits of this warranty are in addition to other rights and remedies you have under a law in relation to the goods or services.
12. Safety and correct use
12.1 Automatic gates, barriers, bollards and road blockers are powered machinery. RJL designs installations to include the safety devices it considers necessary for the site.
12.2 If you decline safety devices or signage that RJL recommends in writing, RJL will record this, and to the extent permitted by law RJL is not liable for loss or injury that the declined devices would have prevented.
12.3 You are responsible for operating the equipment as instructed, training your staff and users, keeping people and vehicles clear of moving parts, reporting faults immediately and stopping use of faulty equipment, and keeping drainage and the area around the equipment clear.
12.4 Impact or crash ratings apply only to the product as tested, installed to the tested foundation design, in the tested arrangement. RJL does not warrant performance against any particular vehicle or attack.
13. Limitation of liability
13.1 Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
13.2 Where goods or services are not of a kind ordinarily acquired for personal, domestic or household use, RJL's liability for failure to comply with a consumer guarantee is limited, as permitted by law, to: for goods, replacing or repairing them or paying the cost of doing so; for services, supplying them again or paying the cost of doing so.
13.3 To the extent permitted by law, RJL is not liable for indirect or consequential loss, including loss of profit, revenue, use, data or business opportunity, except to the extent caused by RJL's negligence or wilful misconduct.
13.4 To the extent permitted by law, RJL's total liability for any claim arising from a job is limited to the price paid for that job, except for death or personal injury caused by RJL's negligence and for liability that cannot lawfully be limited.
13.5 Each party's liability is reduced to the extent the other party, or its contractors, contributed to the loss.
14. Maintenance plans
14.1 A maintenance plan covers the scheduled services listed in it. Parts, repairs found during a service, after-hours work and call-outs are extra unless the plan says otherwise.
14.2 Plans run for 12 months. RJL will send a renewal notice at least 30 days before the end of the term. A plan renews only if you confirm the renewal or keep paying after receiving the notice. You may cancel a renewed plan with 30 days' written notice and receive a refund for services not yet delivered.
14.3 Plan prices may change at renewal. RJL will state the new price in the renewal notice.
15. Call-outs and rapid response
15.1 Call-outs are charged at RJL's call-out rates current at the time, including travel, unless covered by a warranty or plan.
15.2 Response times are targets. They are not guaranteed unless stated in a signed service agreement.
16. Designs, quotes and intellectual property
16.1 Quotes, drawings, designs, specifications, renders and software provided by RJL remain RJL's property and are confidential. You may use them only to assess or carry out the work with RJL.
16.2 You must not give them to another contractor for pricing or use them to have the work done by others without RJL's written consent.
17. Photographs
RJL may photograph completed work for its records and marketing. RJL will not publish your name, address or identifying details without your consent. You may ask RJL not to publish photos of your site.
18. Privacy
RJL handles personal information in line with its Privacy Policy.
19. Disputes
19.1 If a dispute arises, either party must notify the other in writing and the parties must try in good faith to resolve it within 20 business days.
19.2 If it is not resolved, either party may refer it to mediation, or to Consumer Affairs Victoria or the Victorian Civil and Administrative Tribunal where applicable. This clause does not stop either party from seeking urgent relief.
20. General
20.1 These terms are governed by the laws of Victoria.
20.2 If any part of these terms is invalid or unenforceable, it is severed and the rest continues to apply.
20.3 RJL may update these terms. The version in force on the date you accept a quote applies to that job.
20.4 A failure to enforce a term is not a waiver of it.
